Misdiagnosed Woman Wins €6.5M

A woman who was left paralysed after a serious brain haemorrhage was allegedly misdiagnosed as a migraine has received €6.5million in compensation.

Kathleen Myers, 49, a civil servant from The Garth, Belgard Heights, Tallaght, Dublin has been a ward of court since December 2007 and is currently a patient in St Mary's Hospital in the Phoenix Park, Dublin.

She is now confined to a wheelchair with paralysis in both legs and one arm and requires 24-hour care.

In her claim, it was alleged that on March 19, 2005, she developed a severe headache and was sent by ambulance to St James Hospital, where an A&E registrar assessed her.

The registrar made a tentative diagnosis of migraine and organised blood tests. He discharged her on medication, advising her to see her family doctor for a follow-up.

Two days later, she was found unconscious at her home and rushed by ambulance to Tallaght Hospital where a CT scan of her brain recorded a large haemorrhage.

The civil servant's action against St James' Hospital, Dublin, which had conceded liability, began last month.

Mr Justice Daniel Herbert was yesterday told that the hospital had offered €6.5m in settlement and the family's lawyers were prepared to recommend it.
