Jury Retires In Spanish Death Fall Case

A Louth man who is accused of causing the death of his wife while on holiday in February 2000 is soon to receive a verdict.

A jury in Spain has retired to consider the evidence after the trial of Michael Dermot McArdle, (39) from Dundalk.

However, he denies murdering 28-year-old Kelly Anne, who fell four floors from their hotel balcony in Marbella over eight-and-a-half years ago.

On Friday, the state prosecutors decided they were looking for a manslaughter and not a murder conviction, saying they believed Mr McArdle tried to save his wife from falling and there was no proof he killed her in cold blood.

They are now seeking a four-year sentence for manslaughter instead of a 14-year jail term for murder.

Meanwhile, lawyers for the victim's family, hired by them to prosecute him simultaneously, are looking for a murder conviction and a 15-year sentence.

They say his behaviour before, during and after his wife's death led them to believe that he wanted to kill Kelly Anne.

The accused has pleaded not guilty to both charges, telling the nine jurors that his wife tripped and fell over the balcony by accident when she rushed to save her young son, who was near the railing.

Irishman Dies In Holiday Balcony Fall
An Irishman thought to be in his 40s has died in an accident on the Canary Island of Tenerife. It is understood the as yet unnamed man fell from the balcony of a third-floor holiday apartment in the small resort of El Médano late on Tuesday night. Initial reports said the handrail of the balcony gave way.

Dublin Balcony Fall Man Dies
A woman was seriously injured after what gardaí have described as a 'domestic incident' in Dublin early this morning in which a man died. The Lithuanian man, 33, was taken to the Mater hospital with serious injuries after gardaí were called to The Hamptons at Santry Cross, Dublin 9.

Jury Hears Phone Call Made By Paul Byrne As Wife Stabs Him To Death
A jury today heard a 999 phone call made by the late Paul Byrne, crying for help as his wife stabbed him to death. The engineer, 48, told the operator, "My wife is stabbing me", "She is trying to kill me". Mr Byrne was stabbed over 60 times by Tanya Doyle at their home in Pairc Gleann Trasna, Aylesbury, on 4th September 2009.

Another Death As Temperatures Fall
Snow is falling again across many parts of Ireland today with the forecast for the north and northwest overnight giving temperatures as low as -10C. As a result, the Severe Weather Co-ordination Committee has warned ice is now causing a major hazard and people are "driving way too fast".

Irish Nurse In Turkey Death Fall
A young Irishwoman has died after taking a fall during a holiday in Turkey. The woman is believed to be Mary Linnane, and is understood to have fallen from the balcony of an apartment in the early hours of Tuesday morning while holidaying in the resort town of Kusadasi. The trip was reported to be Ms Linnane's first holiday abroad.
