Decision To Overturn Breath Testing Welcomed

The Court of Appeal has overturned a ruling saying that breath tests must be in English and Irish, saying it brings "much needed clarity".

A ruling that breathalyser test statements were not valid if printed in the English language only had held up 1,400 alleged drink driving prosecutions and caused confusion over the last few months.

Fianna Fáil Transport Spokesperson Timmy Dooley TD said: "There was a holdup of 1400 alleged drink driving offences due to this technicality, and it would be a ridiculous situation if these offences could not be proceeded with legally because statements were not valid if only printed in English. I welcome this common sense ruling and the clarity to the situation it has brought."
