Credit Card Surcharge Legislation Will Be Delayed

Legislation to ban controversial credit card surcharges has been delayed.

Additional charges added when using a credit card are to be made law by next june following an EU directive. The Irish government had planned to bring in new legislation earlier than the deadline but lawyers have faced legal difficulties while trying to produce legislation that would comply with the directive, the Irish Independent has reported.

A spokesman for Jobs and Enterprise Minister Richard Bruton, is reported as saying: "The minister has recently received legal advice on this issue from the Office of the Attorney General.

"The advice available states clearly that, due to the wording used in the EU Directive, application and enforcement of the Directive by secondary legislation in advance of the implementation date of June 2014 could be successfully challenged under domestic constitutional law."
