Govt Loses Waterford Crystal Pension Case

Waterford Crystal workers have won their European Court of Justice challenge against the State for the loss of their pensions when the company went bankrupt.

When the company collapsed in 2009 1,500 workers were told they would receive only between 18% and 28% of their full pension entitlements.

Under EU law the State had an obligation to protect the pension entitlements of workers in the event of a company becoming insolvent, a ruling issued in Luxembourg this morning found.

The court said the protection is enshrined in the 2008 Insolvency Directive.

The governments argument that the State contributory pension should be taken into account when assessing how much of the lost pensions should be made up, was rejected by the court.

Thursday morning’s ruling was a preliminary finding and the judges were not expected to spell out how much of their pension entitlements the Waterford employees should get.

The case will now go back to the High Court where it will be decided by how much the State will be liable for the lost pensions of the Waterford workers.

Party's Call For Govt Action On Gender Pension Gap
Fianna Fáil and Sinn Féin have both called for government action on the gender pension gap. FF have tabled an amendment to the Social Welfare Bill which would see the eligibility criteria for the State pension reviewed to ensure that women who took time out of work to look after children or to care for a loved one, are not penalised.

M&S Strike Action Deferred For Emergency Meeting
A one-day strike by staff at Marks & Spencer has been deferred following an intervention by the Labour Court. The strike was due to be held on Friday. It is understood that the strike action has been deferred to allow an emergency hearing to take place at the Labour Court tomorrow.

Translink Workers Reject Pay Offer
Translink NI workers have rejected a pay offer from the public transport company. Unite, GMB and SIPTU confirmed that their members has "decisively voted to reject as inadequate" a pay offer made by Translink management. Workers were offered a 5% pay increase and a non-consolidated one-off payment of £1,500 for the 2023-2024 financial year.

Fianna Fáil Raise Concerns Over Delays In Pension Increases
Some 78,000 pensioners are still waiting on a decision about their entitlement to an increase in the State Contributory Pension, according to Fianna Fáil Spokesperson on Older People and TD for Waterford, Mary Butler. New figures released to Deputy Butler reveal that as of 28th March 2019, only 11,646 of 90,000 reviews have been completed.

Reform Needed To Ensure Women Do Not Lose Out On Full State Pension - O'Loughlin
Reform is needed to ensure women are not denied access to a full pension, Fianna Fáil Spokesperson on Equality Fiona O'Loughlin, has said. Deputy O'Loughlin stated that women who take time out of the workforce to care for children or the elderly relatively risk not having made enough contributions to qualify for the full state pension.
