Anglo 'To Release Withheld Documents'

The Anglo Irish bank has been asked by the Minister of Finance to renege its claim for legal privilege to withhold the submission seized documents during a Commercial Court hearing.

The electronic material and data, relating to some 20 persons, employees of the bank, over the period January 2008 to February 2009, was requested as part of the Director of Corporate Enforcement's investigation into the bank.

The court heard today the Anglo board were written to by the Finance Minister Brian Lenihan who requested they look again at maintaining their claim of legal professional privilege over the documents causing delay to the director’s investigation.

This morning the bank asked for a further adjournment to allow time to consider a letter received from Mr Lenihan.

Counsel for the bank Shane Murphy said in the light of Mr Justice Kelly's request, the Minister had now asked the bank to consider a number of important issues at the highest level.

Earlier this month, Mr Justice Kelly said the bank was legally entitled to assert legal professional privilege over the electronic documents, but it was adding considerably to delays in an already protracted investigation.
