Boy Left Brain Damaged Awarded €8.5m

A young boy who suffered "catastrophic" brain injuries during birth has been awarded €8.5m in damages.

Dylan Gaffney was born at Waterford Regional Hospital in July 2007.

Due to problems suffered by his mother, Jane Gaffney, in previous pregnancies, the family had requested a delivery by Caesarean Section. The hospital, however, talked the family out of this and the request was dismissed.

During labour, Jane Gaffney's womb ruptured and Dylan suffered brain damage as a result. He was also later diagnosed with cerebral palsy and has required 24-hour care since.

At the High Court, the Health Service Executive admitted liability and the award was made to Dylan Gaffney.
