Report Highlights Lenient Sentencing

Judges in manslaughter cases tend to be more lenient if drink and drugs are involved, even though intoxication is not a defence in law or a mitigating factor, a new report on sentencing has found that

A report, carried out by the Irish Sentencing Information System, analysed sentences in manslaughter cases over five years between 2007 and 2012.

Among the finding the report also shows that more than four fifths of those convicted of manslaughter in the cases studied received sentences of nine years in prison or less.

One case, in which a man was sentenced to three years for pulling a victim to the ground and stamping on her head, was highlighted as being "rather lenient".

Of the 42 cases analysed, eight convicted killers received suspended sentences or less than four years in prison.

Another 26 convicted killers were sentenced to between five and nine years in jail, while eight received ten years or more in prison.

The report states that "perhaps further guidance from the Court of Criminal Appeal regarding categories of manslaughter might assist to clarify any ostensible discrepancies".

Bill Published To Reform Criminal Sentencing
Fianna Fáil Spokesperson on Justice Niall Collins has published a Bill to reform the area of criminal sentencing, in order to improve consistency and enhance public confidence in the system. The proposals centre on the establishment of a Judicial Sentencing Commission, similar to the model in England and Wales.

Man On Run For Six Years Is Remanded
A man has been remanded in custody after being on the run for six years after pleading guilty to rape. Christian Moran, originally from Tullow in County Carlow, had admitted to the rape of a 27-year-old woman in 1999. Mr Moran absconded in July 2001 while awaiting sentencing on bail and he was detained last month by the authorities in the US.

12 Years For Double Rapist
A 34-year-old man, who drugged and raped two women after luring them to his home in Dublin, has been jailed for 12 years for. Kapil Garg, a computer specialist originally from India but living in Whitefriar Place in Dublin 8, had pleaded not guilty but a jury found him guilty of the offences, which took place in his rented room in July 2011.

Former Barrister Jailed For 'Creepy' And 'Sexual' Messages
A former barrister has received a three-year jail term for leaving "creepy" and "sexually intimidating" voicemail messages on a younger colleague's mobile phone. 50-year-old Paul McLoughlin, from the North Circular Road originally pleaded not guilty but then admitted what he had done after two days of evidence at the Dublin Circuit Criminal Court.
